Terms and Conditions of Service
Kiwi Coaches
1. Definitions • "Company" refers to Kiwi Charters (2024) Limited. • "Customer" refers to the person or organisation booking services with the Company. • "Services" refers to the transportation services provided by the Company, including bus and coach hire.
2. Bookings and Confirmation
2.1 All bookings must be confirmed in writing (email or signed acceptance of a quote). 2.2 A deposit may be required to confirm your booking. 2.3 Acceptance of a quote constitutes agreement to these terms and conditions.
3. Payment Terms
3.1 Cash accounts require full payment 7 days prior to the date of travel unless otherwise agreed. 3.3 Standard credit account terms are payment in full, 14 days from the invoice date, unless otherwise agreed. 3.2 Late payment may incur interest at 5% per month and may affect future bookings. 3.3 All prices are exclusive of GST unless stated otherwise.
4. Cancellation Policy
4.1 Cancellations must be made in writing. 4.2 The following cancellation fees apply: • More than 14 days before travel: Full refund of any deposits paid. • 7–14 days before travel: 50% of total quoted price. • Less than 7 days before travel: 100% of total quoted price. 4.3 Refunds are at the Company’s sole discretion if cancellation is due to extraordinary circumstances.
5. Force Majeure
5.1 The Company shall not be liable for delay or failure to perform services due to acts beyond its reasonable control, including but not limited to weather events, road closures, mechanical breakdowns, strikes, pandemics, or other emergency conditions. 5.2 In such events, the Company will make reasonable efforts to reschedule or provide alternative services.
6. Changes and Amendments
6.1 Any requested changes to dates, times, or itineraries must be made in writing and are subject to availability. 6.2 The Company reserves the right to charge additional fees for amendments made within 72 hours of departure. Any additional kms or hours requested will be costed into the job.
7. Passenger Conduct and Responsibilities
7.1 The Customer is responsible for the behaviour of all passengers. 7.2 Smoking, alcohol, and illegal substances are not permitted on board any vehicle. 7.3 The Company reserves the right to refuse travel or remove passengers acting inappropriately, with no entitlement to refund. 7.4 Any damage to the vehicle caused by passengers will be charged to the Customer.
8. Delays and Liability
8.1 While all efforts are made to run services on time, the Company is not liable for delays caused by circumstances beyond its control. 8.2 The Company shall not be held liable for any indirect or consequential loss (e.g. missed f lights or connections).
9. Vehicle Allocation
9.1 The Company reserves the right to allocate any suitable vehicle to meet the needs of the booking. 9.2 Where a specific vehicle is requested, the Company will make reasonable efforts to provide it but makes no guarantee of availability.
10. Safety and Compliance
10.1 All vehicles are maintained in accordance with New Zealand transport regulations and subject to Certificate of Fitness (CoF) standards. 10.2 All drivers are licensed and trained to comply with safety regulations and work-time rules.
11. Lost Property
11.1 The Company is not liable for any personal items left on board. Lost property will be held for a limited time before being donated or disposed of.
12. Governing Law 12.1 These terms and conditions are governed by the laws of New Zealand. 12.2 Any disputes not resolved directly with Kiwi Coaches shall be resolved in the courts of New Zealand.
